European Small Claims Procedure: An Effective Process? A Proposal for an Online Platform

Background: Statistics concerning the use of European Small Claims Procedure implemented by Regulation 861/2007 (as amended 2015/2421) show that this mechanism has not been as successful expected. When choosing between a domestic and instrument, creditor most often opts for procedure. They avoid an instrument is less well known, they do fully manage, limited integration in law. Methods: This article starts with legislative analysis 861/2007, using analytical hermeneutic approaches. Empirical methodologies will also be applied since practical application rules established analysed order to build proposal online platform small claims Results Conclusions: Bearing mind weaknesses Procedure, we conclude incorporating alternative dispute resolution mechanisms best option promote access justice. A list arbitrators or judges designated each member state decide cases submitted on could solution overcome lengthy court processes. The decision shall standardised all proceedings according model incorporated into platform. Thus, enforceability facilitated, process more accessible parties, ensuring right justice context.
